1. Introduction
These Terms of Service (“Terms”) govern your use of the Gated Home mobile application and related services (“Service”) operated by Gated Home (“we,” “us,” or “our”). By creating an account, you agree to be bound by these Terms.
If you do not agree to these Terms, do not create an account or use the Service.
2. Eligibility
You must be at least 18 years old to create an account. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
3. Account Registration
3.1. You must provide accurate, complete, and current information during registration (name, email address, password).
3.2. You are responsible for maintaining the confidentiality of your account credentials, including your password, PIN, and any access keys.
3.3. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
3.4. You may not create multiple accounts, share your account with others, or transfer your account without our written consent.
4. Description of Service
Gated Home provides a platform for residential community gate access management, including:
- Remote gate control via mobile application
- Bluetooth Low Energy (BLE) proximity-based gate access
- PIN-based gate access
- Guest access management (temporary access for visitors)
- Guest link sharing (time-limited access URLs)
- Automated licence plate recognition (ALPR) for vehicle-based gate access
- Push notifications for gate activity and security alerts
- Gate activity history and audit logs
- Community event management
- Integration with third-party smart home platforms (Amazon Alexa, Google Home)
- Geofence-based automatic gate opening (“Approaching Home”)
Not all features are available in all communities. Feature availability is determined by your community’s configuration and your subscription tier.
5. Acceptable Use
You agree NOT to:
5.1. Use the Service for any unlawful purpose or in violation of any applicable law in Trinidad and Tobago or your jurisdiction.
5.2. Attempt to gain unauthorized access to gates, communities, or accounts that do not belong to you.
5.3. Share gate access credentials (PINs, PSKs, guest links) with individuals not authorized by the gate owner or community administrator.
5.4. Use the Service to track, surveil, or monitor individuals without their knowledge and consent.
5.5. Reverse engineer, decompile, or disassemble any part of the Service or its firmware.
5.6. Interfere with or disrupt the Service, servers, or networks connected to the Service.
5.7. Use automated scripts, bots, or tools to interact with the Service without our written permission.
5.8. Circumvent any security measures, access controls, or rate limits implemented by the Service.
5.9. Use ALPR data, gate activity logs, or any personal information obtained through the Service for purposes other than gate access control.
6. Community Membership
6.1. Access to the Service requires membership in at least one residential community. Membership is granted via invitation from a community administrator.
6.2. Community administrators may set rules and configurations that affect your use of the Service within their community, including guest limits, feature availability, and access schedules.
6.3. Your community administrator is a separate data controller for community-level data. We act as a data processor on their behalf for certain operations.
6.4. Removal from a community (by an administrator or by your own choice) terminates your access to that community’s gates and features. Your account remains active if you are a member of other communities.
7. Guest Management
7.1. When you add a guest, you represent that you have the authority to grant that person access to your community’s gate(s) within the limits set by your community.
7.2. You are responsible for the actions of guests you authorize. If a guest causes damage or violates community rules, you may be held accountable by your community.
7.3. Guest access may be time-limited, schedule-restricted, or paused by you or your community administrator at any time.
8. Gate Access and Safety
8.1. The Service controls physical gates. You acknowledge that improper use of gate controls can cause property damage or personal injury.
8.2. You agree to use gate controls responsibly and only when it is safe to do so (e.g., no persons, vehicles, or objects in the gate’s path).
8.3. The “auto-close” feature, if enabled, will automatically close a gate after a configured duration. You are responsible for ensuring the gate path is clear.
8.4. We are not liable for any damage, injury, or loss resulting from gate operation, including but not limited to: damage to vehicles, property, or persons caused by gate movement.
8.5. The Service depends on internet connectivity, Bluetooth, and hardware functionality. We do not guarantee uninterrupted gate access. You should maintain alternative access methods (physical keys, manual override) for emergencies.
9. Subscriptions and Payments
9.1. Certain features require a paid subscription. Subscription terms, pricing, and billing cycles are presented at the time of purchase.
9.2. Payments are processed by Stripe. By subscribing, you also agree to Stripe’s Terms of Service.
9.3. Subscriptions renew automatically unless cancelled before the renewal date.
9.4. Refunds are handled on a case-by-case basis. Contact support for refund requests.
10. Third-Party Services
The Service integrates with third-party platforms. Your use of these integrations is subject to their respective terms:
- Amazon Alexa — Alexa Terms of Use
- Google Home — Google Terms of Service
- Stripe — Stripe Services Agreement
- Twilio (SMS/voice) — Twilio Terms of Service
- Firebase Cloud Messaging — Firebase Terms of Service
We are not responsible for the availability, accuracy, or conduct of third-party services.
11. Intellectual Property
11.1. The Service, including its software, firmware, design, and documentation, is owned by Gated Home and protected by copyright and intellectual property laws.
11.2. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
11.3. You may not copy, modify, distribute, sell, or lease any part of the Service.
12. Limitation of Liability
12.1. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
12.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
12.3. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12.4. We are not liable for: gate malfunctions, hardware failures, internet outages, unauthorized access resulting from your failure to secure your credentials, or actions taken by community administrators.
13. Indemnification
You agree to indemnify and hold harmless Gated Home, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third party’s rights
- Damage caused by gates you control through the Service
14. Termination
14.1. You may delete your account at any time through the app or by contacting support.
14.2. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a security risk.
14.3. Upon termination: your access to all communities is revoked, your guests are deactivated, your vehicles are removed from ALPR matching, and your personal data is handled according to our Privacy Policy.
15. Changes to These Terms
15.1. We may update these Terms from time to time. Material changes will be communicated via the app (in-app notification or consent prompt).
15.2. If a change materially affects your rights, you will be asked to re-accept the updated Terms before continuing to use the Service.
15.3. Continued use of the Service after non-material changes constitutes acceptance.
16. Governing Law and Disputes
16.1. These Terms are governed by the laws of the Republic of Trinidad and Tobago.
16.2. Any disputes arising from these Terms shall be resolved in the courts of Trinidad and Tobago.
16.3. Before initiating legal proceedings, you agree to attempt resolution through good-faith negotiation by contacting us at legal@gatedhome.app.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any feature-specific consent agreements, constitute the entire agreement between you and Gated Home regarding the Service.
